DJ TIRA’S T-shirts, Fact Durban Rocks, are famous all over KwaZulu-Natal. But the DJ isn’t making any profit from the sales and now he’s taking the company who allegedly imitated his shirts, to court.
According to Tira, Wicked Clothing Store is reproducing the shirts without his permission.
On Friday the matter was heard before the Durban High Court.
But load shedding forced the case to be postponed for another date. In court documents, Wicked claimed they used the trademark before Tira could formally register it.
Wicked stores are situated at The Workshop and Shaka Marine Wicked Store in Durban.
On Friday, the popular DJ was represented by Vusi Khathi and Advocate Sthembiso Mdladla, who said they were positive they will triumph.
Vusi said: “We’re going to win this case easily.
“We’ve got factual evidence that will prove that DJ Tira is the owner of this clothing trademark.
“Look, everybody knows that this trademark belongs to him. Tira wants these stores to stop trading with his trade name, nothing else. They’ve tried to offer him some money to officially use the trade name but he’s not interested,” he said.
Lawyers representing Wicked refused to comment.
